User Agreement

ARTICLE 1 – PARTIES

1.2 – BUYER

The internet user (“member”) who becomes a member of ADADÜNYA via the website adadunyaoptik.com.

ARTICLE 2 – SUBJECT

The subject of this Agreement is to determine the terms and conditions under which the member may benefit from ADADÜNYA’s website adadunyaoptik.com.

ARTICLE 3 – RIGHTS AND OBLIGATIONS OF THE PARTIES

3.1. The member declares and undertakes that they are over 18 years old when registering on the website adadunyaoptik.com or the Adadünya Optik mobile application; that the personal and other information provided is accurate before the law; and that they will fully and immediately compensate any and all damages incurred by ADADÜNYA due to the inaccuracy of such information.

3.2. The member may not give the password provided to them by ADADÜNYA to any other person or organization; the right to use the password belongs exclusively to the member. Therefore, any liability that may arise and any claims and demands that may be asserted against ADADÜNYA by third parties or competent authorities are reserved, and ADADÜNYA reserves all rights to claim compensation and any other claims arising from such unauthorized use.

3.3. The member accepts and undertakes in advance to comply with the provisions of the applicable legislation while using the website adadunyaoptik.com or the Adadünya Optik mobile application and not to violate them. Otherwise, all legal and criminal liabilities arising therefrom shall be borne solely and exclusively by the member.

3.4. The member may not use the website adadunyaoptik.com or the Adadünya Optik mobile application in any manner that disturbs public order, is contrary to public morals, harasses or annoys others, is for an unlawful purpose, or infringes the intellectual and copyright rights of others. In addition, the member may not engage in activities or actions that prevent or make it difficult for others to use the services (spam, viruses, trojan horses, etc.).

3.5. The ideas and opinions declared, written or used by members on the website adadunyaoptik.com or the Adadünya Optik mobile application are entirely the personal views of the members and are binding on the person expressing such views. These views and opinions have no relation or connection with ADADÜNYA. ADADÜNYA shall not be liable for any damages that third parties may suffer due to the views and opinions declared by the member, nor for any damages that the member may suffer due to the views and opinions declared by third parties.

3.6. ADADÜNYA shall not be responsible for the unauthorized reading of member data or for any damages that may occur to the member’s software and data. The member has accepted in advance that they will not claim compensation from ADADÜNYA for any damages they may suffer due to the use of the website adadunyaoptik.com or the Adadünya Optik mobile application.

3.7. The member agrees not to access or use the software and data of other internet users without authorization. Otherwise, any legal and criminal liabilities arising therefrom shall belong entirely to the member.

3.8. A member who violates one or more of the provisions set forth in this membership agreement shall be personally liable, criminally and legally, due to such violation and shall hold ADADÜNYA harmless from the legal and criminal consequences of such violations. In addition, if the matter is referred to legal proceedings due to such violation, ADADÜNYA reserves the right to claim compensation from the member for non-compliance with the membership agreement.

3.9. ADADÜNYA has the right at any time, unilaterally and when necessary, to delete the member’s membership and to delete files, documents and information belonging to the customer. The member accepts this in advance. In such case, ADADÜNYA shall have no liability.

3.10. The software and design of the website adadunyaoptik.com belong to ADADÜNYA; the copyrights and/or other intellectual property rights related thereto are protected by the relevant laws and may not be used, acquired or modified by the member without permission. Other companies and products mentioned on this website are trademarks of their respective owners and are also protected within the scope of intellectual property rights.

3.11. For the purpose of improving and developing the website adadunyaoptik.com or the Adadünya Optik mobile application and/or within the framework of legal regulations, certain information may be collected, such as the name of the Internet service provider used to access the site and the Internet Protocol (IP) address, the date and time of access to the site, the pages accessed while on the site, and the Internet address of the website that enables direct access to the site.

3.12. ADADÜNYA may use members’ personal information to provide better service to users, improve its products and services, facilitate the use of the site, and conduct studies tailored to users’ preferences and interests. ADADÜNYA reserves the right to keep records of the member’s activities on the Adadunyaoptik.com website or the Adadünya Optik mobile application.

3.13. If the BUYER gives consent by clicking the approval option while registering on the website adadunyaoptik.com or the Adadünya Optik mobile application, they accept and declare that they permit ADADÜNYA to send them e-mails within the scope of marketing activities regarding special discounts and campaigns and various products/services and activities. To unsubscribe from the customer newsletter membership, the member may change their preference via “My Account” → “My Membership Information” → “Update Information” or unsubscribe by clicking the “I want to unsubscribe” link located at the bottom of the e-mails sent to them.

3.14. ADADÜNYA may disclose the member’s personal information when required by legal obligation or when it believes in good faith that such action is necessary to (a) comply with legal requirements or comply with legal processes served on ADADÜNYA; (b) protect and defend the rights and property of ADADÜNYA.

3.15. ADADÜNYA has taken measures within available means to keep the website free of viruses and similar malicious software. However, in order to ensure ultimate security, the user must procure their own virus protection system and provide the necessary protection. In this context, by entering ADADÜNYA’s website, the member shall be deemed to have accepted that they are responsible for any and all errors that may occur in their own software and operating systems and their direct or indirect consequences.

3.16. ADADÜNYA reserves the right to change the content of the site at any time, to change or terminate any service provided to users, or to delete registered user information and data on ADADÜNYA’s website.

3.17. ADADÜNYA may change, update, or cancel the terms of the membership agreement at any time, in any manner, without prior notice and/or warning. Each amended, updated, or repealed provision shall become effective for all members as of the publication date.

3.18. The Parties accept and declare that all computer records belonging to ADADÜNYA shall be taken as the sole and exclusive evidence in accordance with Article 287 of the Code of Civil Procedure (HUMK) and that such records constitute an evidentiary agreement.

ARTICLE 4 – TERM AND TERMINATION

This agreement shall remain in force until the member cancels their membership or until ADADÜNYA cancels the membership. In the event that the member violates any provision of this membership agreement, ADADÜNYA may cancel the membership and unilaterally terminate the agreement.

ARTICLE 5 – COMPETENT COURT

In disputes arising from this agreement, consumer arbitration committees and consumer courts shall have jurisdiction.
