CONSUMER RIGHTS – RIGHT OF WITHDRAWAL – CANCELLATION & RETURN/REFUND TERMS

GENERAL:

  1. If you place an order electronically through the website you are using, you are deemed to have accepted the preliminary information form and the distance sales agreement presented to you.
  2. Buyers are subject to the provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188), as well as other applicable legislation in force, regarding the sale and delivery of the purchased product.
  3. Shipping costs (cargo fees) shall be paid by the buyers.
  4. Each purchased product is delivered to the person and/or entity at the address specified by the buyer, provided that it does not exceed the legal period of 30 days. If the product is not delivered within this period, buyers may terminate the contract.
  5. The purchased product must be delivered complete, in accordance with the specifications stated in the order, and together with any documents such as a warranty certificate and user manual, if applicable.
  6. If the sale of the purchased product becomes impossible, the seller must notify the buyer in writing within 3 days from the date it becomes aware of this situation. The total amount must also be refunded to the buyer within 14 days.

IF THE PURCHASE PRICE IS NOT PAID:

  1. If the buyer does not pay the purchase price or cancels the payment in bank records, the seller’s obligation to deliver the product ends.

PURCHASES MADE THROUGH UNAUTHORIZED USE OF A CREDIT CARD:

  1. If, after delivery of the product, it is determined that the credit card used for payment was unlawfully used by unauthorized persons and the relevant bank or financial institution does not pay the product price to the Seller, the buyer must return the contractual product to the Seller within 3 days, with shipping costs borne by the Seller.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEABLE REASONS:

  1. If force majeure events beyond the seller’s control occur and the product cannot be delivered on time, the buyer will be informed. The buyer may request cancellation of the order, replacement with a similar product, or postponement of delivery until the obstacle is removed. If the buyer cancels the order and paid in cash, the amount will be paid in cash within 14 days from the cancellation date. If the buyer paid by credit card and cancels, the product price will be refunded to the bank within 14 days; however, it is possible that the bank transfers it to the buyer’s account within 2–3 weeks.

BUYER’S OBLIGATION TO INSPECT THE PRODUCT:

  1. Before accepting delivery of the goods/services subject to the contract, the buyer shall inspect them and shall not accept delivery from the shipping company if the goods/services are damaged or defective (dented, broken, torn packaging, etc.). The goods/services accepted shall be deemed undamaged and intact. The BUYER is obliged to protect the goods/services with due care after delivery. If the right of withdrawal is to be exercised, the goods/services must not be used. The invoice must also be returned together with the product.

RIGHT OF WITHDRAWAL:

  1. The BUYER may exercise the right of withdrawal by rejecting the goods, without assuming any legal or penal liability and without providing any reason, within 14 (fourteen) days from the date of delivery of the purchased product to the buyer or the person/entity at the address indicated by the buyer, provided that the seller is notified via the contact details below.

DURATION OF THE RIGHT OF WITHDRAWAL:

  1. If the purchase is for a service, this 14-day period starts from the date the contract is signed. In service contracts where performance begins with the consumer’s consent before the withdrawal period expires, the right of withdrawal cannot be exercised.
  2. The costs arising from the exercise of the right of withdrawal shall be borne by the Seller.
  3. In order to exercise the right of withdrawal, a written notice must be sent to the Seller by registered mail with return receipt, fax, or e-mail within the 14 (fourteen) day period, and the product must not have been used within the framework of the “Products for Which the Right of Withdrawal Cannot Be Exercised” provisions set forth in this agreement.

EXERCISING THE RIGHT OF WITHDRAWAL:

  1. The invoice of the product delivered to the 3rd person or the BUYER must be returned (If the invoice of the product requested to be returned is issued to a company, it must be sent together with the return invoice issued by that company. Returns of orders invoiced to companies cannot be completed unless a RETURN INVOICE is issued.)
  2. The return form, and the box/packaging of the products to be returned, along with any standard accessories, must be delivered complete and undamaged.

RETURN/REFUND TERMS:

  1. The Seller is obliged to refund the total amount and the documents that put the BUYER under debt within a maximum of 10 days from the date the withdrawal notice reaches the Seller, and to take back the goods within 20 days.
  2. If there is a decrease in the value of the goods due to the BUYER’s fault or if return becomes impossible, the BUYER is obliged to compensate the Seller’s damages in proportion to its fault. However, the BUYER is not responsible for changes or deterioration resulting from proper use of the goods/product within the withdrawal period.
  3. If the withdrawal causes the order total to fall below the campaign limit set by the Seller, the discount amount benefited under the campaign will be cancelled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:

  1. Products prepared in line with the BUYER’s request or clearly personal needs and not suitable for return; underwear bottom parts, swimsuits and bikini bottoms, cosmetics, single-use products, goods that are at risk of spoiling quickly or are likely to expire; products that are not suitable for return due to health and hygiene reasons if their packaging is opened by the BUYER after delivery; products that are mixed with other products after delivery and cannot be separated by nature; periodicals such as newspapers and magazines outside the scope of subscription agreements; services performed instantly in electronic environment or intangible goods delivered instantly to the consumer; and audio/video recordings, books, digital content, software programs, data recording and storage devices, computer consumables, if their packaging has been opened by the BUYER, cannot be returned in accordance with the Regulation. In addition, the right of withdrawal cannot be exercised for services whose performance has started with the consumer’s consent before the withdrawal period ends.
  2. For cosmetics and personal care products, underwear products, swimsuits, bikinis, books, copyable software and programs, DVD, VCD, CD and cassettes, and stationery consumables (toner, cartridge, ribbon, etc.) to be eligible for return, their packaging must be unopened, untested, undamaged, and unused.

DEFAULT AND LEGAL CONSEQUENCES

  1. If the BUYER falls into default when making payments by credit card, the BUYER accepts, declares, and undertakes that it will pay interest within the framework of the credit card agreement between the cardholder and the bank and will be responsible to the bank. In this case, the relevant bank may take legal action and demand the resulting expenses and attorney fees from the BUYER; and in any case, if the BUYER falls into default due to its debt, the BUYER accepts that it will compensate the Seller for the losses and damages incurred due to delayed performance of the debt.
